You, as a customer or third party, agree to fully comply with this Usage Policy, as well as any future updates, with respect to the processing of personal data.
The services provided by Gubax are subject to its Privacy Policy. Gubax will carry out the processing of personal data strictly necessary for the performance of the contract, credit control, compliance with legal or regulatory obligations, as well as for the regular exercise of rights, or in any other legally authorized case, always in accordance with the principles and provisions of Law No. 13.709/2018 (General Personal Data Protection Law – LGPD).
The customer undertakes to protect the privacy and legal rights of the end users of its services, being solely responsible for providing adequate privacy notices and adopting the technical and organizational measures necessary to protect the personal data processed.
If end users provide personal data to the customer, the customer must inform them clearly and transparently that such information may be processed within the scope of the contracted services and, when applicable, by Gubax, to the extent necessary for the provision of the service.
The customer declares awareness that it is solely and exclusively responsible for the processing of the personal data of its end users, and must fully observe the rules, principles and obligations set forth in the LGPD, including obtaining consent when required, and meeting the rights of data subjects.
In the event that Gubax receives requests from data subjects related to information whose processing is the customer's responsibility, such requests will be forwarded to the customer within 24 (twenty-four) hours, and it is the customer's responsibility to take the necessary measures to meet the rights set forth in the LGPD.
The customer releases and holds Gubax free from any liability for administrative, judicial or extrajudicial claims arising from non-compliance with the obligations set forth in data protection legislation or copyright law, when resulting from a negligent or willful act for which it is responsible.
In such cases, the customer undertakes to fully reimburse Gubax for any amounts it may disburse due to court judgments, settlements, administrative sanctions, fines, indemnities, interest, damages or losses, within a maximum of 10 (ten) days from receipt of extrajudicial notice.
